Terms & Conditions

These terms apply to every private charter aboard Rex Sailing's vessels Cap II and Flying Wing, and to day-charters departing from Antigua. They form a contract between the named lead guest (the 'Charterer') and Rex Sailing (the 'Operator'). By confirming a booking with a deposit payment, the Charterer agrees to these terms on behalf of all guests in the party.

1. Booking and confirmation

An enquiry received through the website, email, WhatsApp, or a travel advisor is a request — not a confirmed booking. A charter is confirmed only when we return a written booking confirmation and the Charterer pays the non-refundable deposit below within seven days.

2. Deposit and final payment

Unless agreed otherwise in writing:

  • 50% deposit at confirmation (non-refundable, except as set out in Section 4).
  • 50% balance no later than 45 days before the charter start date.
  • For day charters: 30% deposit, balance 14 days before departure.
  • All amounts are in US Dollars (USD). Bank fees on international transfers are borne by the Charterer.

3. What is included

Each private charter includes full crewed service, meals and soft drinks on board, water toys and snorkelling equipment, fresh linens and towels, and fuel for a standard cruising day. Specific inclusions are listed on the yacht page and confirmed at booking.

4. Cancellation by the Charterer

Cancellations must be sent in writing to dispatch@rexsailing.com and are effective on the date received. Where the charter is rebooked to another party for the same dates, the Operator will refund up to 50% of the balance paid.

  • More than 90 days before departure: deposit forfeit.
  • 60–90 days before departure: 50% of total charter fee payable.
  • 30–59 days before departure: 75% of total charter fee payable.
  • Under 30 days or no-show: 100% of total charter fee payable.
  • Travel insurance is strongly recommended to cover these risks (see Section 8).

5. Cancellation by the Operator

If the Operator cancels a charter for reasons attributable to the vessel or crew and cannot offer an equivalent replacement, a full refund of all amounts paid will be issued. Beyond this refund, the Operator is not liable for incidental travel, accommodation, or other expenses incurred by the Charterer or guests.

6. Force majeure

Neither party is liable for delay or failure to perform arising from events beyond reasonable control, including but not limited to adverse weather, named storms, port or customs closures, mechanical failure despite proper maintenance, acts of government, epidemic, or civil unrest.

Where a charter is prevented by force majeure, the Operator will, in good faith and where practicable, offer: (a) a postponement to alternative dates within 12 months at the same rate, or (b) a proportional refund reflecting costs already incurred. The Operator's liability is in any case capped at the total charter fee paid.

7. Weather and itinerary

The Captain has absolute authority over the vessel, crew, and itinerary, including route changes, early returns, or delayed departures required for the safety of the yacht and guests. Such decisions are not grounds for refund.

8. Insurance

The vessel carries commercial yacht hull and third-party liability insurance appropriate to its class and flag. This cover does not extend to personal injury, illness, belongings, or trip cancellation of guests.

Each guest is required to hold personal travel and medical insurance covering the duration of the charter and the geography of the itinerary. Proof may be requested at boarding.

9. Conduct and safety

Guests agree to follow the reasonable instructions of the Captain and crew, particularly those relating to safety, anchorage etiquette, and respect for local customs and protected marine areas. The Captain may refuse boarding or disembark any guest whose conduct endangers the vessel, the crew, other guests, or the reputation of the Operator, without refund.

No illegal substances are permitted on board. Consumption of alcohol is permitted in moderation; the Captain may restrict it where safety requires.

10. Damage and loss

The Charterer is responsible for damage caused to the vessel, its equipment, or property of the Operator by any guest in the party beyond normal wear and tear. A damage waiver or security hold may be required at the Operator's discretion.

11. Photography

Crew and guests may occasionally take photographs during the charter. The Operator will not publish identifiable images of guests without permission. If the Charterer prefers no photography at all, let us know at confirmation.

12. Privacy

Personal information is handled in accordance with our Privacy Policy, which is incorporated into these terms by reference.

13. Governing law

These terms are governed by the laws of Antigua and Barbuda. Any dispute not resolved by good-faith discussion will be submitted to the courts of Antigua and Barbuda, unless both parties agree otherwise in writing.
